The Gym Rathdowney – Membership Terms and Conditions

 

Effective Date: 12th of November 2025 

 

1. IntroductionWelcome to The Gym Rathdowney ("the Gym", "we", "our", "us"). These Terms and Conditions ("Terms") apply to all members, guests, and visitors. By joining, using, or visiting the Gym, you agree to abide by these Terms, our Code of Conduct, and all posted rules or policies. We reserve the right to refuse entry or terminate membership for breach of these Terms, inappropriate behaviour, or conduct deemed unsafe or disruptive. 

 

2. Memberships and PaymentsWe offer a range of memberships including monthly, annual, and fixed-term options. Full details and pricing are available at reception or online.All fees are payable in advance by direct debit, debit/credit card, or cash. Monthly memberships renew automatically unless cancelled in accordance with Section 6. If a payment fails or is cancelled by the member’s bank, the Gym reserves the right to suspend access until all outstanding amounts are paid. Unpaid fees may be referred to a third-party recovery agency, and the member shall be liable for any associated costs. Prices include VAT and may be adjusted with a minimum of 30 days’ notice. Promotional or discounted memberships are subject to their stated conditions and may not be transferred. Memberships are personal and non-transferable. Misuse, sharing, or unauthorised access will result in termination without refund. 

 

3. Use of FacilitiesAll members must check in or book sessions via our app or reception.Proper gym attire and footwear must be worn at all times.Members must clean equipment after use and return weights to racks. Unsafe, disruptive, or abusive behaviour will not be tolerated. This includes misuse of equipment, verbal abuse, intimidation, or harassment of staff or other members. Such behaviour may result in immediate suspension or permanent termination without refund. Members agree to follow all health, safety, and hygiene protocols. This includes compliance with any temporary restrictions or policies (e.g., during maintenance, upgrades, or public health requirements). 

 

4. Health, Safety, and Risk AcknowledgementExercise carries inherent risks. Members are responsible for ensuring they are medically fit to participate in physical activity. We strongly recommend consulting a doctor before starting any fitness program, especially if you have an existing health condition, injury, or are pregnant. By using the Gym, you accept and acknowledge that participation in physical exercise and use of fitness equipment involves risk of injury. The Gym will not be liable for any injury, illness, or death unless directly caused by our proven negligence. Members must report any accidents, injuries, or equipment issues to staff immediately. 

 

5. Personal BelongingsThe Gym is not responsible for loss, theft, or damage to personal items on the premises, including those stored in vehicles, or common areas. Valuables should not be left unattended. Items left overnight may be removed and disposed of. 

 

6. Cancellation and TerminationCooling-Off Period: Members joining online or off-site may cancel within 14 days for a full refund if facilities have not been used. Ongoing Memberships: May be cancelled with 30 days’ written notice to thegymrathdowney@gmail.com. Fixed-Term Memberships: Are binding for the full term and cannot be cancelled early except in verified medical circumstances or permanent relocation over 100km away. Proof will be required for early termination. Gym Termination Rights:We reserve the right to terminate any membership for:Failure to pay fees, Breach of rules or misconduct, Unsafe or antisocial behaviour, False information at sign-up. In such cases, no refunds will be provided.​

 

7. Photography, Video, and CCTVThe Gym uses CCTV for security, safety, and operational monitoring. Recordings are kept in accordance with data protection law and may be used in the event of an incident or investigation. We may also take photos or videos on-site for marketing, social media, and promotional purposes. Entry to the premises implies consent to appear in such media in general gym settings. We will take care to avoid featuring identifiable individuals without consent, but incidental inclusion may occur. If you prefer not to appear, please notify staff before entering workout areas during media activity. Members may not record, photograph, or film others without explicit permission. 

 

8. Personal Training and Third PartiesOnly authorised Gym Rathdowney personal trainers may provide instruction or training on-site. Members are not permitted to bring outside trainers, sell services, or conduct business activities within the premises without written consent. We are not liable for any loss, injury, or dissatisfaction resulting from services provided by third-party contractors or trainers. 

 

9. Opening Hours and ClosuresNormal opening hours are displayed online and at reception.We reserve the right to alter hours or temporarily close the Gym for maintenance, staff training, events, or public holidays. No compensation or extension will be provided for closures of less than 14 consecutive days.In the event of a closure beyond 14 days, memberships may be extended at our discretion. 

 

10. Data Protection and CommunicationWe handle personal data in compliance with GDPR and the Data Protection Acts 1988–2018. Data is collected to manage memberships, ensure safety, and provide updates on Gym operations, promotions, and events. We may contact members by email, SMS, or phone for legitimate business purposes. Members can request access, correction, or deletion of their data by contacting thegymrathdowney@gmail.com

 

11. Liability and IndemnityMembers use all facilities at their own risk. To the fullest extent permitted by law, The Gym Rathdowney and its staff shall not be liable for any loss, damage, or injury occurring on the premises unless caused by proven negligence. Members agree to indemnify and hold harmless The Gym from any claims, costs, or damages resulting from their actions, misuse of facilities, or breach of these Terms. 

 

12. Force MajeureWe are not liable for failure to provide services or access due to circumstances beyond our reasonable control, including but not limited to fire, flood, pandemic, government restrictions, strikes, or power failure.

 

13. Changes to TermsWe may revise these Terms at any time. Members will be notified of significant changes at least 14 days in advance. Continued use of the Gym after changes take effect constitutes acceptance of the new Terms.

 

14. Governing LawThese Terms are governed by the laws of Ireland. Any disputes shall be resolved exclusively by the Irish courts.
